Providing online access to our will and trust forms allows us to serve a broader attorney base and quickly communicate updates and revisions made due to changes in regulations, estate law or other circumstances.
Using Our Forms
These forms are designed to assist the legal community in preparing wills and trust agreements for your clients. You must, of course, assume responsibility for the form’s applicability and validity, and for the resulting tax and non-tax consequences. The effect of state law on the proposed will or trust agreement is an important factor to be considered in determining the applicability of a form. You should also be aware of developments in the law that might have bearing on the applicability or validity of the forms.
Each form contains explanatory side notes* designed to assist you with drafting. Please be sure to delete the side notes* when drafting your clients' documents. Please consult the UMB Trust Locations page to determine which UMB location will best serve each of your clients. The forms have been prepared without a specific reference to any UMB location. Select either UMB Bank, n.a. or UMB Trust Company of South Dakota, depending upon your client's needs.**

Serving Our Clients
We appreciate the designation of UMB as corporate fiduciary in your client’s estate planning documents. When you send documents to us in which UMB is designated as a fiduciary, please include in your cover letter the following information, if available:
- Client’s name, address and telephone number
- Client’s approximate age or date of birth
- Approximate dollar value of client’s estate
- Client’s Social Security number
In lieu of the above information, feel free to send us a copy of the completed first page of the UMB Confidential Estate Planning Questionnaire, which is available in our forms area. All information received will be held in the strictest of confidence.

* For Microsoft Word users: The easiest way to remove the side notes from most forms is to right click with your mouse on the first side note and then choose Delete Cells followed by Delete Entire Column. This should delete the explanatory notes column. Then use your mouse to adjust the width of the remaining column or Convert Table to Text under Table. For a few documents, this process must be repeated on the first couple of pages.

The UMB Will & Trust Forms (“Forms”) are provided by UMB Bank, n.a., and its affiliates and subsidiaries (“UMB”), in their entirety and free of charge, only to attorneys at law for use in drafting documents for their respective clients. The Forms are designed to assist attorneys in preparing estate plans for their clients. UMB does not guarantee or represent that the Forms effectively accomplish any particular purpose and UMB disclaims all responsibility to any person for the Forms or their use in any particular manner. An important factor to be considered in determining the applicability of any form is the effect of state law on the proposed document. The attorney should also be alert to developments in the law subsequent to the issuance of the Forms, which might have a bearing on the applicability or validity of the Forms. By using the Forms, you acknowledge and agree that: (a) you are an attorney at law; (b) you have the experience and knowledge necessary to select and use the Forms in a manner that is appropriate for your clients; (c) you have the experience and knowledge necessary to recognize and understand the tax and other estate planning issues and consequences presented by the Forms; (d) you will discuss these issues and consequences with your clients; (e) you will help your clients make appropriate decisions with respect to these issues and consequences; (f) you will edit and complete the Forms as necessary to give effect to these decisions and in a manner that does not contradict or materially modify the Forms, including, without limitation, incorporating appropriate applicable state law; (g) you (and not UMB, nor any of its officers, directors, employees or agents (the “Released Parties”)) are responsible and assume all risk for any document which you prepare based wholly or in part on the Forms; (h) you accept complete responsibility for your use of the Forms and you acknowledge and agree that the Released Parties will not accept any responsibility or have any liability for your use of the Forms and shall have no duty to verify that you comply with the conditions outlined above in (a)-(f); and (i) the Released Parties, in making the Forms available to you, are not engaged in rendering legal or other professional services or advice. By using the Forms, you waive any and all claims against the Released Parties based on or arising out of such use.
