The attorney should also be alert to developments in the law subsequent to the issuance of the Forms, which might have a bearing on the applicability or validity of the Forms. Each of the Forms (except for the Confidential Estate Planning Questionnaire) contains explanatory side notes, which describe some, but not all, of the potential tax and non-tax consequences of the form provisions they accompany. These explanatory side notes are informational only and should not be relied upon for any particular purpose. These explanatory side notes should be deleted from any documents drafted for clients, and the format should be reviewed prior to use.
